TradieFeed Terms of Service

1. Agreement

By creating an account or subscribing to TradieFeed you agree to these Terms and our Privacy Policy (tradiefeed.com/privacy). If you subscribe on behalf of a business, you confirm you are authorised to bind that business.

2. The service

TradieFeed is a subscription information service. We collect publicly available building permit and planning application information for Victorian council areas, organise and tag it, and deliver the records relevant to your selected council area(s) and trade via our website dashboard and email digests.

What the service is not: TradieFeed provides information about projects and properties, not introductions, appointments or guarantees of work. We do not provide property owners' or applicants' names or contact details. Leads are records of publicly notified building and planning activity; whether they turn into work for you depends on your own outreach.

3. Accounts

You must provide accurate account information and keep your login credentials secure. One account covers one business. You are responsible for activity under your account. You must be at least 18 and using the service for business purposes.

4. Subscriptions, billing and trials

Plans and pricing are as displayed at tradiefeed.com/pricing at the time you subscribe. Prices are in Australian dollars.

Billing: subscriptions are billed monthly in advance by card through our payment processor, Stripe, and renew automatically each month until cancelled. Your first billing date follows the end of any free trial.

Free trial: new subscribers receive a [30]-day free trial. A valid payment card is required to start the trial. If you cancel before the trial ends, you will not be charged; otherwise the subscription continues automatically at the plan price when the trial ends.

Price changes: we may change prices with at least 30 days' written notice. A price change never applies retrospectively and does not affect a current billing period. If you don't accept a price change, you may cancel before it takes effect.

Failed payments: if a renewal payment fails, we will retry and notify you. Access may be suspended if payment remains outstanding 14 days after the due date.

5. Cancellation and refunds

You may cancel at any time through your account (Manage subscription) or by emailing admin@tradiefeed.com. Cancellation takes effect at the end of the current billing period; you keep access until then. We do not charge cancellation fees.

Refunds: because billing is monthly and you can cancel anytime, we do not generally refund for change of mind or partly used periods. Nothing in this clause limits your rights under the Australian Consumer Law — if the service fails to meet a consumer guarantee (for example, it is substantially unavailable or not fit for its stated purpose), you are entitled to the remedies the law provides, which may include a refund. To raise a problem, contact admin@tradiefeed.com.

6. Acceptable use

You must not: (a) resell, republish, redistribute or provide access to the service's data feeds to any third party outside your business, whether free or paid; (b) scrape, crawl, bulk-export beyond provided export features, or reverse-engineer the service; (c) share your login with other businesses; (d) use the service to send unsolicited commercial electronic messages in breach of the Spam Act 2003 (Cth), or otherwise use information from the service unlawfully; (e) interfere with the operation or security of the service.

We may suspend or terminate accounts that breach this clause, with notice where practicable.

7. Data sources, accuracy and disclaimer

Our data comes from public sources: building permit records published by the Building and Plumbing Commission (BPC) via DataVic (used under the Creative Commons Attribution 4.0 licence) and planning application information published on public council registers.

These sources are compiled by third parties from information supplied by others. The BPC itself does not warrant that its data is accurate, authentic or complete, and neither do we. Records may be delayed, amended, withdrawn or contain errors at the source. Coverage and update frequency vary by council and are described at [tradiefeed.com/how-it-works].

To the extent permitted by law, the service and its data are provided "as is" and we do not guarantee that any record is current, accurate or complete, or that the service will be uninterrupted or error-free. This clause does not exclude, restrict or modify any consumer guarantee or other right you have under the Australian Consumer Law that cannot lawfully be excluded.

The service provides factual information, not professional advice. It is not building, planning, legal or financial advice.

8. Intellectual property

We own the TradieFeed platform, software, branding, and the selection, arrangement, tagging and presentation of data within the service. Underlying public-register facts are not claimed as our property; BPC data remains subject to its CC BY 4.0 licence. You receive a non-exclusive, non-transferable right to use the service and to use exported data within your own business for your own business development. This right ends with your subscription, except for records you have already lawfully used in your business.

9. Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited (at our option) to resupplying the service or paying the cost of resupply.

Subject to the above, and to the extent permitted by law: (a) we are not liable for business decisions you make in reliance on the service, including quoting, travel, or marketing costs relating to any lead; (b) we are not liable for indirect or consequential loss; and (c) our total aggregate liability in connection with the service in any 12-month period is limited to the amounts you paid us in that period.

10. Suspension and termination

We may suspend or terminate your account for material breach of these Terms (including non-payment or breach of clause 6). You may terminate at any time under clause 5. On termination your access ends; clauses 7–9 and any accrued rights survive.

11. Changes to the service and these terms

We are an evolving service; features, data sources and council coverage may change. We will not materially reduce what your plan includes mid-billing-period. We may update these Terms with at least 14 days' notice by email for material changes; continued use after the effective date constitutes acceptance. If you don't accept updated Terms, you may cancel under clause 5.

12. General

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of Victorian courts. If any clause is found invalid, the remainder continues in effect. Our failure to enforce a clause is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business restructure or sale with notice to you.
